1. Overview

Welcome to Witchsey, a metaphysical multi-vendor marketplace designed to support spiritual creators and their communities. These Terms of Use (“Terms”) constitute a legally binding agreement between you (“you,” “your,” or “User”) and Witchsey LLC (“Witchsey,” “we,” “us,” or “our”).

By accessing, browsing, or using www.witchsey.com (including all subdomains, applications, and services provided by Witchsey — collectively, the “Platform”), you agree to be bound by these Terms and all additional policies incorporated herein by reference.

If you do not agree to these Terms, you may not use or access Witchsey.

2. Eligibility

You must be at least 18 years old to use the Platform.
 Minors aged 13–17 may use the Platform only under the direct supervision of a parent or legal guardian, who is responsible for their actions.

Metaphysical vendors must apply and be approved before listing items. Witchsey reserves the right to deny, suspend, or revoke vendor access at any time.

3. Account Registration & Responsibilities

To use most features of Witchsey, including purchasing or selling, you must register an account. You agree to:

  • Provide accurate, current, and complete information during registration.

  • Keep your login credentials confidential.

  • Be solely responsible for activity under your account, whether authorized or not.

  • Notify Witchsey immediately of unauthorized access or suspected breaches.

Witchsey is not liable for losses arising from unauthorized account use.

4. Prohibited Uses

You agree that you will not:

  • Violate any law, regulation, or third-party rights.

  • Sell or list prohibited, fake, dangerous, or culturally appropriated items.

  • Circumvent fees or Witchsey’s checkout system (e.g., transact off-platform).

  • Use the Platform for fraud, scams, or money laundering.

  • Engage in abusive, harassing, discriminatory, or hateful conduct.

  • Use bots, crawlers, scrapers, or reverse-engineering tools.

  • Interfere with the security, performance, or functionality of the Platform.

5. Platform Use and Marketplace Role

Witchsey provides a venue for metaphysical vendors and buyers to connect. Witchsey does not take title to items, guarantee sales, or endorse listed products.

Each vendor is solely responsible for:

  • The products listed and sold.

  • Order fulfillment, including shipping and returns.

  • Ensuring compliance with local and international laws.

Buyers understand that Witchsey is not a party to transactions and is not liable for any issues with products or vendors.

6. Intellectual Property Rights

6.1 Witchsey IP

All content on the Platform, including text, graphics, logos, design, and software, is the intellectual property of Witchsey or its licensors and is protected by U.S. and international copyright, trademark, and other laws.

6.2 Vendor Content

Vendors retain ownership of their product listings, descriptions, photos, and shop names, but grant Witchsey a non-exclusive, worldwide, royalty-free license to use, reproduce, display, promote, and distribute such content on or through Witchsey and affiliated channels for marketing and platform operations.

You warrant that you own or have proper authorization to use and license all content you upload.

7. User-Generated Content

Users may post reviews, comments, shop updates, or other public content. You agree:

  • To only post content that is truthful and lawful.

  • That Witchsey may moderate, remove, or restrict such content at its discretion.

  • That you grant Witchsey a license to use and display this content as part of platform functionality.

Witchsey is not liable for any content posted by users.

8. Fees, Billing & Taxes

Witchsey charges fees for vendor listings, transactions, and optional services. Details are available in the Witchsey Fee & Payment Policy.

You agree to:

  • Pay all applicable fees assessed by Witchsey.

  • Maintain accurate payment and billing information.

  • Allow Witchsey to deduct owed fees from your sales or charge your account.

8.1 Sales Tax Collection & Remittance

Witchsey currently does not collect or remit sales tax on behalf of vendors until legal tax nexus thresholds have been met. As of the date of this policy, Witchsey has not yet reached nexus in all U.S. states and therefore does not universally withhold or remit sales tax.

However, once Witchsey establishes an economic or physical nexus in any state or jurisdiction:

  • Witchsey will begin charging, collecting, and remitting sales taxes as required by law.

  • Taxes may be automatically applied to relevant purchases at checkout.

  • Vendors authorize Witchsey to withhold such taxes from the transaction amount.

  • Witchsey will remit collected taxes directly to the required authorities.

9. Termination and Suspension

Witchsey may terminate or suspend your access at any time, with or without notice, for violation of these Terms or applicable laws.

Upon termination:

  • Your right to use the Platform ends immediately.

  • Outstanding fees remain payable.

  • Witchsey may retain or delete your account data, subject to our Privacy Policy.

You may close your account at any time by contacting support.

10. Dispute Resolution and Release

10.1 User Disputes

Disputes between buyers and sellers should be resolved through direct communication. Witchsey may offer assistance but is not obligated to mediate or resolve disputes.

10.2 Binding Arbitration (U.S. Users Only)

Any dispute arising out of or relating to these Terms will be resolved through binding individual arbitration under the rules of the American Arbitration Association (AAA). You waive your right to bring claims in court or as part of a class action.

This section does not apply to claims of intellectual property infringement or violations of law that allow for injunctive relief.

10.3 Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.

11. Disclaimers and Limitations of Liability

Witchsey provides the Platform “as is” and “as available.”

We do not guarantee uninterrupted service, accuracy of listings, or outcomes from use.

To the fullest extent permitted by law, Witchsey disclaims all warranties, express or implied, including warranties of merchantability and fitness for a particular purpose.

Witchsey shall not be liable for any indirect, incidental, consequential, or punitive damages, including loss of profits, revenue, or data.

In no event will Witchsey’s total liability exceed the greater of:
 (a) $100 USD or
 (b) the total fees paid to Witchsey by you in the past 12 months.

12. Modifications to Terms

Witchsey may modify these Terms at any time. Changes take effect immediately upon posting or as specified. Continued use of the Platform after changes constitutes your acceptance. You are responsible for reviewing updates periodically.

13. Miscellaneous

Severability: If any part of these Terms is found unenforceable, the remainder shall remain in effect.
 No Waiver: Witchsey’s failure to enforce any provision shall not be considered a waiver.
 Entire Agreement: These Terms, along with all referenced policies, constitute the entire agreement between you and Witchsey.
